Qualified domestic relations orders (QDRO) are the best way divorcing couples can divide their retirement savings and avoid early withdrawal penalties, according to this article. QDRO apply to 401(k)s and similar plans governed under the Employee Retirement Income Security Act of 1974. Experts suggest that divorcing couples begin working on their QDRO early in the divorce proceedings, and closely follow the advice of their fund company regarding the orders.
